1. AGREEMENT TO TERMS

Welcome to Ikaika’s Beauty (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website and the purchase of any products offered through our store.

By accessing our website or purchasing from us, you agree to be legally bound by these Terms. If you do not agree, you may not use this site or purchase our products.

We reserve the right to update, modify, or replace any part of these Terms at our sole discretion. Continued use of the site constitutes acceptance of any changes.

2. ELIGIBILITY

You must be at least 18 years old or have the consent of a legal guardian to use this site.

You agree not to use our products for any unlawful purpose or in violation of any applicable federal, state, or local law.

3. PRODUCT INFORMATION & COSMETIC DISCLAIMER

We strive to ensure product descriptions, pricing, and images are accurate. However, we do not warrant that all content is error-free, complete, or current.

All products sold by Ikaika’s Beauty are cosmetic in nature and are not intended to diagnose, treat, cure, or prevent any medical condition.

By purchasing from us, you acknowledge:

  • Individual results may vary.
  • You are responsible for reviewing ingredient lists before use.
  • A patch test is recommended prior to full application.
  • Products are for external use only unless otherwise specified.
  • Discontinue use if irritation occurs.

Ikaika’s Beauty shall not be liable for allergic reactions, misuse, improper storage, or failure to follow instructions.

4. ORDER ACCEPTANCE

We reserve the right to refuse, limit, or cancel any order at our sole discretion, including but not limited to:

  • Suspected fraudulent activity
  • Pricing or listing errors
  • Inventory shortages
  • Bulk purchasing or unauthorized resale
  • Orders flagged by fraud prevention systems

An order confirmation email does not constitute final acceptance of your order.

5. PRICING

All prices are subject to change without notice. We reserve the right to correct pricing errors even after an order has been placed.

6. SHIPPING, TITLE & RISK OF LOSS

Shipping timeframes are estimates and are not guaranteed.

Title and risk of loss pass to the customer upon transfer of the products to the shipping carrier.

Ikaika’s Beauty is not responsible for:

  • Carrier delays
  • Lost or stolen packages marked as delivered
  • Customs delays
  • Incorrect addresses provided by the customer

Customers are responsible for ensuring accurate shipping information at checkout.

We are not responsible for delays caused by customs inspections or international shipping regulations.

7. RETURNS, REFUNDS & CHARGEBACKS

All returns and refunds are governed by our separate Refund Policy, which is incorporated into these Terms by reference.

Filing a chargeback without first contacting us to resolve the issue constitutes a violation of these Terms and may result in:

  • Permanent account restriction
  • Refusal of future service
  • Submission of evidence to payment processors

8. INTELLECTUAL PROPERTY

All website content — including logos, branding, product names, images, text, graphics, and designs — is the exclusive property of Ikaika’s Beauty and is protected by intellectual property laws.

Unauthorized reproduction, distribution, or commercial use is strictly prohibited and may result in legal action.

9. DISCLAIMER OF WARRANTIES

All products and services are provided “AS IS” and “AS AVAILABLE” without any warranties of any kind, either express or implied, including but not limited to:

  • Implied warranties of merchantability

We do not guarantee uninterrupted, secure, or error-free service.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by Texas law, Ikaika’s Beauty shall not be liable for:

  • Indirect, incidental, punitive, or consequential damages
  • Loss of profits, revenue, or data
  • Cosmetic dissatisfaction
  • Allergic reactions or skin sensitivity
  • Service interruptions

Any claim arising out of or related to the use of our products must be filed within one (1) year after the claim arose, or it is permanently barred.

In all cases, our total liability shall not exceed the amount paid for the product giving rise to the claim.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Ikaika’s Beauty from any claims, damages, losses, liabilities, or expenses arising out of:

  • Your misuse of our products
  • Your violation of these Terms
  • Your violation of any law or third-party rights

12. FORCE MAJEURE

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, supply chain disruptions, carrier delays, governmental actions, or system failures.

13. ELECTRONIC COMMUNICATIONS

By using this site, you consent to receive electronic communications from us. You agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing.

14. DISPUTE RESOLUTION & BINDING ARBITRATION

Any dispute arising out of or relating to these Terms or the purchase of products shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

Arbitration shall take place in Texas.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

Each party shall bear its own legal fees unless otherwise required by law or determined by the arbitrator.

15. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

16. SEVERABILITY

If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
